Filing a Takedown Notice
Under 17 U.S.C. § 512(c)(3), your notice must include:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing and where it is located on hammerandhail.com (for example, the page URL), with enough detail for us to find it.
- Your contact information: name, address, telephone number and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
Review and Actions Taken
Upon receipt of a valid, complete Takedown Notice, Hammer & Hail will act expeditiously to remove or disable access to the allegedly infringing material. We will also make a good-faith attempt to notify the user, contributor or partner who posted or provided the material so they may submit a Counter-Notification if they believe the removal was a mistake.
Repeat infringers: Hammer & Hail may, in appropriate circumstances, remove content from and terminate access for users of the community board who are repeat infringers.
Counter-Notification Procedures
If you believe that your material was removed or disabled by mistake or misidentification, you may file a written Counter-Notification with our Designated Agent. To be valid, your Counter-Notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, that you consent to the jurisdiction of any federal court where the service provider may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
Important Legal Warning
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to severe financial liability, including court costs and attorneys’ fees incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by us.
